• Harass, abuse, defame, stalk, threaten, or defraud any user.
• Post or share graphic content, nudity, violence, or hate speech.
• Post photos or content that you do not have the legal right to use, or impersonate any other person.
• Attempt to harvest personal information or financial details from other users.

4. Zero Tolerance and Safety Measures

We enforce a strict Zero Tolerance Policy against harassment, fraudulent profiles, and malicious behavior. To protect our community:

• We utilize manual moderation and facial verification technologies to confirm user authenticity.
• Any account determined to be engaging in catfishing, scams, or abuse will be banned permanently without warning.
• Users can report suspicious behavior directly inside the app, and reports are treated anonymously.

5. Proprietary Rights and Licensing

All rights, title, and interest in and to our Services, including graphics, code, and user interface, are owned exclusively by Spark. We grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use our platform solely in accordance with these Terms.

By uploading photos, text, or profile content on Spark, you grant us a non-exclusive, royalty-free, transferable license to display, host, and store that content to provide and promote the Services.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPARK DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ON OR OFF THE PLATFORM.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPARK, ITS AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR INABILITY TO ACCESS THE SERVICES.
